I Definitions
1. Service Provider: FORMUŁA B 1-3-5
Spółka z o.o., NIP 9721309637 with its registered office at st. Karpia 10, 61-619 Poznań.
2. FORMUŁA B 1-3-5 Platform
(hereinafter referred to as the "Platform"): an Internet platform
available at www.formulab135.com, through which the Service Provider and Users
post content related to their activities;
3. Platform User (hereinafter
referred to as the "User"): a person using the Platform;
4. Administrator: the Platform User
responsible for the operation of the platform and authorized to manage the
accounts of other Users;
5. Content: substantive materials
made available on the Platform;
6. Data: User's personal data
provided by the User during registration and while using the Platform;
II General provisions
1. The Platform is intended to be
used by Users to participate in sports events and gives the Users the
opportunity to arrange to play friendly matches. All this using a system that
connects the virtual world with the real game.
2. By registering on the Platform
and creating an account, the User confirms that they have read the content of
these Regulations and agree to all its provisions.
3. The platform is available on a
continuous basis, subject to the right to temporary shutdowns due to breakdown,
maintenance, update or technical requirements.
4. To use the Platform, you need a
computer or mobile device with Internet access, a standard operating system, an
installed standard web browser and a connected camera with appropriate
parameters. Detailed requirements are described in point (LINK).
5. For the proper use of the
Platform, it is required to enable cookies in the web browser, which can be
removed through the appropriate options available in the web browser. Detailed
information on cookies is included in the Privacy Policy.
III Types and scope of services
provided online
1. Participation in Tournaments and
Leagues organized by the Service Provider on the basis of separate Regulations
and the possibility of arranging and playing friendly matches between Users;
2. Access to the content and
materials contained on the Platform - the ability to watch matches live and
preview them at a later date, access to Users' statistics and information on
sports events
IV Login to the Platform
1. The User using the Platform may
create an account and gain access to all functionalities of the Platform.
2. Each User may only set up one
account on the Platform.
3. When creating an account,
complete the Registration Form.
4. It is forbidden to include any
illegal content in the Form.
5. In order to send the Registration
Form and complete the registration procedure, it is necessary to accept the
Platform Regulations and the Privacy Policy.
6. After completing and sending the
Form, an activation e-mail will be delivered to the e-mail
address provided in
the Form. After activating the account, the registration process is completed.
7. After completing the registration
and creating an account, the User gains access to their profile on the
Platform, through which they can participate in the games organized by the
Service Provider,
as well as communicate with other Users in order to play a
friendly match;
8. From the level of his account,
the User will be able to use all the possibilities offered by the Platform.
V Scope of use
1. The purpose of the Platform is to use it to organize sporting events via the Internet and to give Users the option of arranging friendly matches and tournaments with the possibility of winning cash or material prizes or tournaments and friendly matches without prizes.
2. The platform was created for
recreational purposes, enabling Users to actively spend their free time and
compete at various levels of advancement;
3. Access to the content and
materials posted on the Platform is free, and participation in the games
offered by the Service Provider is payable on the basis of separate
regulations;
4. Using access to the Platform,
materials and other services available on the Platform is voluntary;
5. The Platform may be used only for
the purposes specified in the Regulations and in accordance with applicable
law. It is forbidden for the User to provide the Service Provider's IT system
with illegal content, as well as:
a) causing work disturbance or
overloading the ICT systems of the Service Provider or other subjects directly
or indirectly participating in the provision of electronic services;
b) violating the interests of third
parties, violating generally accepted social standards or inconsistent with
generally applicable laws.
6. The User may use the Platform and
the materials contained therein on the terms of Creative Commons: Attribution -
Non-commercial use - No derivative works 3.0 Poland (CC BY NC ND), provided
that the User has no right to copy or modify the Platform software and/or
accompanying documentation in any way.
7. It is forbidden to publish on the
Platform any content and materials (including photos and videos) that could
infringe the rights of third parties, in particular copyrights. Publication of
the aforementioned content and materials may take place only with the consent
of their creator or other administrator of these rights.
VI Sports events (tournaments,
leagues, etc.)
1. Registered Users of the Platform
may take part in sports events organized by the Service Provider on the basis
of separate regulations.
2. In the case of organizing sports
events, information about them will be placed on the Platform and sent to the
User to the e-mail address provided during registration.
VII Technical requirements,
threats related to the use of the Internet
1. In order to use the Platform and
the IT system enabling participation in the Service Provider's games, the User
must meet at least the following technical requirements:
a) have a computer or mobile device
with access to the Internet;
b) have a camera with the following
parameters ( see>>);
c) have an e-mail account;
d) have access to websites via a
properly configured web browser;
e) have a modern web browser that
supports the latest HTML 5 and CSS 3 technologies.
2. Failure by the User to meet the
technical requirements indicated in the above point (in particular, a different
or incomplete configuration of computer and audiovisual equipment or software)
may lead to the inability to use the Platform.
3. The use by the User of the
services provided on the basis of the Regulations does not involve any
particular risks for the User related to the use of electronic services, except
for those commonly encountered when using the public teleinformatic network.
VIII Responsibility Disclaimer of
the Service Provider
1. The Service Provider is not
responsible in particular for:
a) any damage caused to third
parties as a result of the User's access to the services in a manner
inconsistent with the Regulations or applicable law;
b) any damage caused to third
parties as a result of providing false data by the User on the registration
form;
c) for the inability to use the
Platform due to the User's failure to meet the technical requirements indicated
in point VII, section 1 of these Regulations.
IX Filing a complaint
1. The User has the right to submit
complaints regarding access to the Platform and other services. Complaints may
be submitted in particular for the lack of or improper access to services.
2. The user reports any
irregularities related to the use of the platform to the e-mail address:
3. The Service Provider will make
every effort to remove irregularities in the event of their occurrence, as
technically possible, within the time limits specified by the external provider
of the Platform.
4. The Service Provider does not
guarantee that the software and content on the platform will meet the
expectations and requirements of the User and that their functioning on the
User's device will be completely error-free and that it is compatible with each
operating system on which it is used. The Service Provider is not responsible
for any damage incurred to the User as a result of incorrect functioning of the
platform.
5. The deadline for considering the complaint is 30 days - from the date of receipt of the complaint.
6. Complaint handling procedure.
a) Complaints regarding defects in the Service should be sent by the User to the Service Provider's address in writing. You can also inform the Service Provider about sending the notification by e-mail to the following e-mail address: info@formulab135.com .
b) The complaint should contain a detailed description of the Service defect and the user's request, possibly also photographic documentation.
c) The service provider undertakes to consider the complaint within 14 days.
If the Service Provider does not respond to the User's complaint within 14 days, it is considered to be justified.
d) If the complaint is accepted, the Service Provider will take appropriate action in accordance with the User's request.
e) We provide the possibility of using extrajudicial means of dealing with complaints and redress in legal relations with Users.
X Final Provisions
1. The provisions of these
Regulations may be changed.
2. The Service Provider may
terminate the operation of the Platform at any time.
3. The Administrator reserves the
right to temporarily disable access to the Platform in order to perform the
necessary works related to the maintenance and improvement of the software and
content. The administrator will make every effort to ensure that the frequency
and duration of the suspension of the service are as little inconvenient as
possible for the User
